4.1 What type of information does Fame collect?

Fame collects two basic types of information from you in conjunction with your use of the Fame app (collectively, your “personal information”): (1) personally identifiable information; and (2) non-personally identifiable information.

  • Examples include your name, e-mail address, telephone number, postal address, device identifiers, IP addresses, and financial account information that you provide.

  • We may also collect personally identifiable information about you from third parties such as data vendors.

  • Aggregate and/or de-identified information is not considered personally identifiable information.

We may also use web beacons and mobile application plug-ins, such as software development kits, application programming interfaces, and similar technologies. We use these and other similar technologies for security, to monitor traffic, to improve our Services, and make the Fame platform easier to use and more relevant to you. We may also use these technologies to personalize your experience, deliver advertisements, and for research and marketing. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs, or pixel tags), in connection with the Fame Services to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. 

Third-Party Analytics we may use automated devices and applications to evaluate the usage of our Site. We use these tools to help us improve our Site, performance, and user experiences. These entities may use cookies and other tracking technologies to perform their services.

  • Provide the Fame Services and customer support

  • Resolve disputes and collect payments and/or fees

  • Communicate about accounts or transactions and send information about features and enhancements

  • Communication Changes to our policies

  • Personalize content and experiences, including providing recommendations based on your preferences

  • Send offers or promotions for the Fame Services

  • Provide advertising, including advertising based on your use of Fame Services or third-party websites

  • Perform statistical, demographic, and marketing analyses of users of Fame Services and their purchasing patterns

  • Conduct any other legitimate business activities not otherwise prohibited by law.

4.4 How do we share personal information? We will only share your personal information with third parties as described in this Privacy Policy. We may share your personally identifiable information with:

  • Third parties for any legitimate business purpose not otherwise prohibited by law We will not share or sell any personally identifiable information about you to our affiliates or non-affiliated third parties for their marketing purposes unless you have provided consent, except as set forth in an agreement you have entered with Fame.

Transfer of Personal Information

5.1 Third-Party Processor within the US

Fame may engage the services of third parties to process your Personal Information collected by Fame. Fame will put in place the right measures to ensure that there is adequate protection of Personal Information in accordance with the terms of this Privacy Policy.

5.2 Transfer of Personal Information to Foreign Country

Where Personal Information is to be transferred to a country outside Africa, Fame shall put adequate measures in place to ensure the security of such Personal Information. The transfer of Personal Information out of Africa would be in accordance with the provisions of the African country's Data Protection Regulation. Fame will, therefore only transfer Personal Information out of Africa on one of the following conditions:

  • Your consent has been obtained;

  • The transfer is necessary for the performance of a contract between you and Fame or implementation of pre-contractual measures taken at your request;

  • The transfer is necessary to conclude a contract between Fame and the third party in your interest;

  • The transfer is necessary for reason of public interest;

  • The transfer is for the establishment, exercise, or defense of legal claims;

  • The transfer is necessary in order to protect your vital interests or other persons to where you are physically or legally incapable of giving consent. Fame will take all necessary steps to ensure that Personal Information is transmitted in a safe and secure manner.

Grounds for Processing of Personal Information

Processing of Personal Information by Fame shall be lawful if at least one of the following applies:

  • You have given consent to the processing of his/her Personal Information for one or more specific purposes;

  • the processing is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract;

  • processing is necessary for compliance with a legal obligation to which Fame is subject;

  • processing is necessary to protect your vital interests or of another natural person; and

  • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official public mandate vested in Fame. For the purpose of this Privacy Policy, consent means any freely given, specific, informed and unambiguous indication of your wishes by which they, through a statement or a clear affirmative action, signify their agreement to the processing of Personal Information relating to them.

Choices and Rights

Individuals who have Personal Information held by Fame are entitled to reach out to Fame to exercise the following rights:

  • Right to request for and access their Personal Information collected and stored. Where data is held electronically in a structured form, such as in a database, you have a right to receive that data in a common electronic format;

  • Right to information on their personal information collected and stored;

  • Right to objection or request for restriction;

  • Right to object to automated decision making;

  • Right to request rectification and modification of Personal Information which Fame keeps;

  • Right to request for deletion of their data;

  • Right to request the movement of data from Fame to a third party; this is the right to the portability of data; and

  • Right to object to, and to request that Fame restricts the processing of their information Your request will be reviewed by Fame and carried out except as restricted by law or Fame’s statutory obligations. You may decline to provide your Personal information when it is requested by Fame, however, certain services or all the services may be unavailable to you. You may review your account settings and update your Personal Information directly or by contacting us.

The Data that We Retain

We will retain your information for as long as your account is active or as needed to provide our services to you, comply with our legal and statutory obligations or verify your information with a financial institution.

Fame is statutorily obligated to retain the data you provide us with in order to process transactions, ensure settlements, make refunds, identify fraud and be in compliance with laws and regulatory guidelines applicable to us, our banking providers and card processors.

Therefore, even after closing your account with Fame, we will retain certain Personal Information and transaction data to comply with these obligations. All Personal Information shall be destroyed by Fame where possible. For all Personal Data and records obtained, used and stored by Fame, we shall perform periodical reviews of the data retained to confirm the accuracy, purpose, validity and requirement to retain.

The length of storage of Personal Information shall, amongst other things, be determined by:

  • the contract terms agreed between Fame and the Data Subject or as long as it is needed for the purpose for which it was obtained; or

  • whether the transaction or relationship has statutory implication or a required retention period; or

  • whether there is an express request for deletion of your Personal Data, provided that such request will only be treated where you are not under any investigation which may require Fame to retain such Personal Data or there is no subsisting contractual arrangement with you that would require the processing of the Personal Data; or

  • whether Fame has another lawful basis for retaining that information beyond the period for which it is necessary to serve the original purpose.
